These terms of use (the “Terms”) are entered into by and between you and Crystal Lagoons for the access and use of the Web Sites “www.crystal-lagoons.com” and “https://www.crystal-lagoons.com/public-access-lagoons/” (the “Sites”), including any content, functionality, and services offered on or through the Sites and apply to any current or future translations of our Sites available worldwide.
By accessing or using the Sites you agree to these Terms for yourself and all persons (including minors) or entities for whom you navigate or request information on the Sites. You represent that you have all necessary rights and consents to agree to these Terms on behalf of your party. If you do not agree to these terms, you may not use the Sites.

By sending information to Crystal Lagoons or its affiliates through the contact form of the Website or by email pertaining to ideas, existing or prospective inventions, confidential information, know-how or information that is or may be subject to any Intellectual or Industrial Property right, you accept that such information was unsolicited and submission or acceptance of the information imposes no obligation on Crystal Lagoons, and in particular: i) Crystal Lagoons has no obligation to review the information; ii) Crystal Lagoons does not have any obligation to keep the information confidential, even if it is marked as such; iii) the sending or receipt of such information does not constitute Crystal Lagoons’ acknowledgement or presumption of acknowledgement, nor puts Crystal Lagoons or its affiliates on notice about anything, including the existence of any third-party rights; and iv) Crystal Lagoons may have the right to use the information received for any purpose, with no restrictions, including the improvement of its current or future products or services, without any obligation to pay any compensation, royalty, license or the like.
Crystal Lagoons name and logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Crystal Lagoons or its affiliates. You agree to defend, indemnify, and hold harmless Crystal Lagoons, its affiliates, and their respective shareholders, stakeholders, officers, directors, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Sites, including, but not limited to, any use of the Site’s content, services, and products other than as expressly authorized in these Terms.
All information we collect on the Sites may be analyzed and controlled by Crystal Lagoons pursuant to our Privacy Policy. By using the Sites, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.
The Sites may contain third-party advertising and links to Web pages of clients, project developers, and other third parties not owned or controlled by Crystal Lagoons which are provided for your convenience only. Therefore, we are not responsible for the content of those pages or the privacy practices of those sites. We encourage you to be aware when you leave our Sites and to read the privacy policies of other sites that may collect your personal information.
No waiver by Crystal Lagoons of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Crystal Lagoons to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
These Terms and our Privacy Policy constitute the sole and entire agreement between you and Crystal Lagoons regarding the Sites and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Sites.
The Sites are operated by Crystal Lagoons. All notices of trademark, copyrights or any other intellectual property related infringement claims should be directed to our agent ip@crystal-lagoons.com.

We may collect two types of information: the information listed in item N°1 below that you may directly provide to us (“Personal Data”) and the information listed in items N° 2 to N°4 below which we may collect automatically when you navigate through our Sites (“Anonymous Data”).
1. Information related to your name, company, country, email address, and how you heard about us.
2. Location information, including information provided by a mobile or other device interacting with one of our Sites, or physical properties using Crystal Lagoons technology and/or intellectual property, or associated with your IP address or other online or device identifier, or tracking technologies, where we are permitted by law to process this information.

We do not collect Personal Data automatically but we may tie this information to Personal Data about you that we collect from other sources or you provide to us.
We may use Personal Data and Anonymous Data information to create a third type of information called “Aggregate Information”. Aggregate Information means information about groups or categories of users, which cannot reasonably be used to identify you individually.

Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Sites. Instructions for Making Access and Deletion Requests
You may submit an access or deletion request yourself or through an authorized agent on your behalf at legal@crystal-lagoons.com. An authorized agent must have your signed permission to submit a request on your behalf or provide proof that they have power of attorney in accordance with California probate law. Authorized agents that are business entities must be registered with the California Secretary of State to conduct business in California. Before completing requests from authorized agents, we may contact you directly to confirm you’ve given your permission and/or to verify your identity.
Shine the Light Act
If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by certain members of Crystal Lagoons group to third parties for the third parties’ direct marketing purposes. Pursuant to California Civil Code Section 1798.83(c)(2), members of Crystal Lagoons group do not share users’ personal information with other member companies or others outside Crystal Lagoons and its affiliates for those parties’ direct marketing use unless a guest elects that we do so.

Removal of Content
